Bernard Condon SC, for Mr FitzPatrick, said he would be arguing that two EY auditors who are to give evidence were coached and that Mr O’Connell allowed the auditors “contaminate” each others’ statements. He also said he would be arguing that Mr O’Connell did not conduct a fair investigation.

Mr O’Connnell agreed that at the time the air was “thick with risk” for EY and that the firm is now being sued by the Irish Bank Resolution Corporation, into which Anglo has since been subsumed.
